These sales conditions regulate the purchases and orders made by Customers to Wippio S.r.l. through the website www.wippio.com.
The website www.wippio.com of Wippio S.r.l. allows you to buy, against payment of a price, clothing and accessories.
Wippio S.r.l. is not a manufacturer of goods, but a reseller without warehouse; therefore the goods offered for sale through the website www.wippio.com are produced by business partners of the same Wippio S.r.l. and sent by them directly to customers.
In case of orders including several goods, the lack of one of the products requested does not give the right to refuse the remaining.
Users who want access the website and benefit from the Services must have access to the Internet (any related connection costs are exclusively at his expense) and the necessary material (in this case computer, modem or any other means of connection).
1. CUSTOMER REGISTRATION
1.1 The customer who wants to use the e-commerce service of the site www.wippio.com can proceed as a registered user (owner of a personal page on the site); at the time of registration the user must enter his/her personal data: he/she must certify to be no under 18 years old; he/she must indicate one or more addresses where he/she will be delivered the products purchased, a valid email address, and an indication whether the user is registering as a private person (consumer) or as a professional / company (subject to VAT).
1.2 The customer who does not want to register can still use the e-commerce service of the site www.wippio.com as a guest user. In this case, for the purpose of the validity of the order and the subsequent shipping and invoicing operations, when the user sends the order, he/she must in any case enter his/her personal data, certifying that he/she is over 18 years old; he/she must indicate one or more addresses, where the products purchased will be delivered, a valid email address, and an indication whether the user is making the purchase as a private person (consumer) or as a professional / company (subject to VAT).
1.3 In the case of a VAT subject, the correct entry of the requested data is essential for the issue of a valid invoice for tax purposes (deductions, etc..).
1.4 The customer can also access the website www.wippio.com through his/her Facebook or Google account.
1.5 All data entered by the customer will be processed by Wippio S.r.l. in full compliance with the law as provided in the Privacy Notice.
2. METHODS OF PURCHASE
2.1 For each product in the catalog are listed:
a) the technical data sheet (e.g. available sizes, colours, composition, etc.);
b) an image accompanying the product, which has a purely simplifying function;
c) price of the single product.
2.2 Any additional charges, custom duties and import VAT in the territories that require them are charged to the Customer. The Customer residing in one of these territories is requested to inquire at the customs office of competence of his country. The prices shown on the website do not include any additional charges, custom duties and import VAT.
2.3 By placing an order, Customer declares to have read all the information provided during the purchase procedure and to have accepted these conditions of sale in full. In this regard, we invite the customer to always check the accuracy of their personal data entered and the data and quantities relating to products placed in the cart.
2.4 Orders placed through the website www.wippio.com will be considered completed only after sending an order confirmation by Wippio S.r.l. (which the customer is invited to store) to the email address indicated by the customer during registration or forwarding of the order as a guest user. The order confirmation email will contain the order number, the type and quantity of products purchased, the billing data and the address where the goods are delivered.
2.5 In the event that within two working days from the purchase the Customer has not received the order confirmation email, he/she can contact Wippio S.r.l. directly by writing to the e-mail address support@wippio.com.
2.6 Wippio S.r.l. reserves the right to modify at any time the products included in the site and their price list. These changes will not have effect for orders already placed.
2.7 Wippio S.r.l. keeps its online catalogue constantly updated by inserting new products. If, due to extraordinary circumstances, the products are no longer available after the order has been sent, Wippio S.r.l. will promptly inform the Customer of any unavailability through the email address indicated by the same during registration or forwarding of the order as a guest user and will refund the price of the product no longer available (if already paid by the Customer). In any case, the unavailability of a part of the order does not give the right to refuse the other goods.
3. PAYMENTS
3.1 Wippio S.r.l. accepts payment by credit/debit card through the platform STRIPE. The payment will be made within the website www.wippio.com, but the data will be managed exclusively by the payment platform and Wippio will not be aware of the data thus released (except for the last 4 numbers of the credit card for mere verification). At no time during the purchase procedure Wippio S.r.l. will be able to know the financial information of the customer. For each transaction made the customer will receive a confirmation email.
4. ORDER RECEIPT AND INVOICING
4.1 Wippio S.r.l. will send an order receipt with the order summary or issue a single invoice for each order placed by the Customer, even if it includes more than one product. The order receipt or the invoice will include the price of the single products ordered, the shipping costs, the additional expenses linked to specific forms of payment chosen by the Customer.
4.2 The order receipt or the invoice will be made out to the Customer using the personal or corporate data that the same has declared at the time of registration or forwarding of the order as a guest user at the site www.wippio.com.
4.3 The order receipt or the invoice will be sent to the customer by e-mail at the time of order confirmation.
5. SHIPPING
5.1 The shipment of the purchased product(s) will be carried out directly by the manufacturer, commercial partner of Wippio S.r.l., through a trusted courier or other suitable means chosen by the Customer. The delivery will be made to the shipping address indicated by the Customer at the time of registration or forwarding of the order as guest user.
5.2 The shipping costs are charged to the Customer. The amount of the shipping costs will be displayed in the purchase procedure before the customer proceeds with the purchase and in any case will be separately reported on the order summary receipt or on the invoice.
5.3 The goods will be shipped in a packaging diligently prepared by the manufacturer, business partner of Wippio S.r.l. Upon receipt of the order, in case of shipping by courier, the customer is required to verify that the number of packages delivered correspond to that reported on the transport document, and that the packaging is intact.
5.4 In case of shipping by courier, if a lower number of packages has been delivered compared to those indicated in the transport document, or if the same are damaged, the customer must indicate the circumstance on the delivery note, and giving notice to Wippio S.r.l. by e-mail to be sent to support@wippio.com. If the courier does not allow the customer to indicate the circumstance on the delivery note, he/she must REFUSE THE GOODS. This is the only procedure that allows Wippio S.r.l. to be able to manage immediately the file of complaint with the courier and that allows you to quickly return any not intact goods. If the Customer does not follow the procedures indicated above and signs the delivery note for acceptance, he will not be able to make any objection later about the external characteristics of the goods delivered to him concerning the goods received.
6. DEFECTIVE PRODUCTS
6.1 In the event that the customer receives defective products, the rules provided by the Codice Civile Italiano in Articles 1490-1495 will apply, except for the applicability in favor of private person (consumer) of the most favorable rules introduced by Decreto Legislativo 206/2005 in Articles 128-135.
6.2 The Customer who intends to request the replacement of defective products, must necessarily send the same, carefully packed, complete with all their parts, together with a copy of the order receipt or purchase invoice and the description of the defect found, to the registered office of Wippio S.r.l. The customer is responsible for shipping the returned goods until the communication of receipt by Wippio S.r.l. Upon arrival, the returned goods will be examined by Wippio S.r.l. to assess any damage or tampering resulting from causes other than transport. Wippio S.r.l. reserves the right to verify the actual existence of the flaws complained and make the replacement or refund (including the reimbursement of shipping costs) only after this check.
6.3 For any clarification or possible complaint, the customer can contact Wippio S.r.l. by writing to the e-mail address support@wippio.com.
7. LIMITATION OF LIABILITY
7.1 In no case Wippio S.r.l. can be held responsible for delays in delivery due to negligence or in general fault of the express courier or the delivery system chosen by the customer, for days of closure relating to national holidays, for strikes, for unforeseeable circumstances or force majeure.
8. WITHDRAWAL FROM THE CONTRACT
8.1 The Customer registered as a private person (consumer acting for purposes other than the activity or profession which he may pursue), who makes purchases through the e-commerce service of the site www.wippio.com, may exercise the right of withdrawal provided for in Articles 52-59 of Decreto Legislativo 206/2005 and subsequent additions and amendments.
8.2 The Consumer has the right to withdraw from the contract without penalty and without specifying the reason within 14 days from the receipt of the products purchased.
8.3 The customer who wants to withdraw from the purchase contract must send within 14 days a written notice sent by registered letter with acknowledgement of receipt to Wippio S.r.l. in via Umberto I n. 43 – 33034 Fagagna (UD). The customer can use the withdrawal form or any other explicit declaration of withdrawal from the contract.
8.4 Proof of submission will be given by the stamp of delivery of the letter to the post office.
8.5 The notice may also be sent by e-mail within the same period, provided that it is confirmed by registered letter with acknowledgement of receipt within the following 48 hours.
8.6 In the event that the Consumer intends to exercise the right of withdrawal after the carrier has taken charge, he must proceed at his own risk and expense to return any purchased products received, intact and unused, complete with original packaging, by sending by express courier to Wippio S.r.l., Via Umberto I n. 43 – 33034 Fagagna (UD), within 14 days from the date on which he informed us that he wants to exercise the right of withdrawal. In any case Wippio S.r.l. will not accept damaged products or used.
8.7 In the event that the Consumer activates the right of withdrawal, Wippio S.r.l.,within 14 days from the date on which it received the notice of withdrawal and verified the integrity of the returned products, will refund all payments made by the Consumer, except for the costs of returning the goods. The refund will be made on the same method of payment used by the Consumer for the initial transaction unless otherwise agreed.
9. APPLICABLE LAW AND JURISDICTION
9.1 The purchase contracts entered through the website www.wippio.com are concluded in Italy, governed by Italian law and subject to Italian jurisdiction.
9.2 Any disputes concerning the validity or execution of contracts concluded through this site and the interpretation of these terms of sale, which may arise between Wippio S.r.l. and a customer with a VAT number will be referred exclusively to the competent court of Udine.
9.3 Any disputes concerning the validity or execution of contracts concluded through this site and the interpretation of these conditions of sale, which may arise between Wippio S.r.l. and a private person (consumer) will be referred to the competent court identified pursuant to art. 66 bis of Decreto Legislativo n. 206/2005 (Consumer’s Court) and its subsequent amendments.
